Advertising planning and development matters

Our Local Planning Policy 1.1 Planning Process and Decision Making sets out the process for dealing with planning/development applications and other planning matters.

When do we advertise planning and development matters?

  • When the proposed land use is not permitted in that zone unless Council exercises discretion and grants planning approval after advertising
  • When we are required to exercise judgement and the development may adversely affect the amenity of surrounding property owners or occupiers.
  • When we undertake a performance assessment against the relevant provisions of the R-Codes in relation to lot boundary setbacks, visual privacy, solar access for adjoining sites
  • All applications for mixed use and major developments.
  • Proposals to modify an existing condition of planning approval or previously approved plans, if they were the subject of previous All subdivision applications to create 10 or more green title or survey strata lots.

We will also advertise:

  • Proposals to amend, revoke or introduce new Council and local planning policies or other planning document which guide development such as Activity Centre Plans.
  • Proposals to amend Local Planning Scheme No.6.
  • All proposals to close an existing Pedestrian Access Way
  • When we are considering, or have received a proposal, to re-number existing properties.
  • Proposed ground leases and sale of City owned property.

We may also advertise when:

  • Proposed land use is not required to be advertised.
  • Proposed residential development does not require mandatory advertising, but advertising may assist in the decision making process.

How and where do we advertise?

The level we advertise will depend on the likely impact of the proposed development. When the impact will likely be confined to adjoining property owners, we will engage with them directly. If the development application is likely to impact the wider community, or there are legislative requirements, we will advertise more broadly and call for submissions via Melville Talks.

What we do with community feedback

We accept any submissions made in writing. For a submission to be considered when assessing a development application it must address a 'relevant planning matter' as defined below.

Relevant Planning/Development Matters

Non-Relevant Planning/Development Matters

  • Matters to be considered under Clause 67 of Schedule 2 of the Planning and Development (Local Planning Schemes) Regulations 2015; and/or
  • The requirements of Local Planning Scheme No.6 or applicable planning instrument (activity centre plan, structure plan, local development plan or planning policy) which requires the decision maker to exercise judgement; and/or
  • Any development standard requiring the decision maker to exercise judgement against the design principles of the R-Codes.
  • Perceived loss of property value
  • Private disputes between neighbours including access & egress and easements
  • Dividing fence issues
  • Matters that are usually dealt with by the building licence process
  • Impact of construction work
  • Trade competition concerns (in most circumstances)
  • Personal morals or views about the applicant
  • Matters that are controlled under other legislation

If we are not the decision maker and we are preparing a report for the Development Assessment Panel or Council, we will include a summary of all relevant planning matters raised and our recommendations.
