About the Alfresco Dining Permit
Under the Thoroughfares, Public Places and Trading Local Law 2014, food businesses need to have a permit to offer outside seating on the public land directly outside their premises.

Things to Consider Before Applying
To apply for a permit your food business needs to be registered and compliant with the Food Act 2008 (WA) and the Food Regulations 2009.
There are also several other requirements that need to be met, which are detailed below.
Public Liability Insurance
You will need public liability insurance with a minimum of $10 million coverage, which includes the use of the footpath area or proposed outdoor eating area outside of your business. You will need to provide your Certificate of Currency as part of your application.
Furniture Selection, Maintenance and Cleanliness
All furniture placed in the alfresco dining area needs to be made of durable materials and kept in a good, clean and serviceable condition. This includes any decorative items, such as pot plants, and other items such as umbrellas.
You must also ensure the alfresco dining area is always kept clean and well-maintained.
Furniture Placement and Removal
All furniture must be placed directly outside of your business, either along the building edge or kerbside, and only if space permits. A pedestrian clear zone of 1.8m must always be maintained. If the furniture is placed next to the kerb there must be a 600mm clearance zone from the kerb.
All furniture (including decorative items) must be removed at the close of each business day unless otherwise approved by us.
Permanent Furniture and Installations
If you want to install permanent furniture or make permanent changes to the verge (e.g., new paving or removal of street furniture, signs or bus stops) you will be required to provide specific information about the infrastructure affected/proposed, which will be subject to consideration by us. Please include this information as supporting documentation with your application.
Alfresco Dining on a Street Corner or a Major Road
Please contact us first if your food business is located on a street corner or a major road (i.e., Canning Highway, Leach Highway, South Street, Stock Road or Roe Highway)
