The Kardinya Shopping Centre landowner initiated two projects in 2020, the Shopping Centre Redevelopment and the Activity Centre Plan proposal, below are background details of what has occurred so far for these projects. 

Community Feedback Opportunity

We asked you to share your feedback by 4.00pm on Monday, 8 May 2023 about the Statutory Planning Committee (SPC) proposed Activity Centre Plan (ACP) modifications and the required Scheme Amendment.

SPC Proposed Modifications

The SPC proposed a number of modifications to the modified ACP recommended by the City. 
  • The inclusion of the area bounded by Hodgson Place, Williamson Road, South Street and the rear boundary of properties on the eastern side of Sexton Court as shown in this image in red for the first time. The modification proposes increasing the density coding within this area from R25 to R40 and R60.
Changes to the City's recommended modifications to the original ACP:
  • Removing from the ACP, the area bounded by Bayless Road, Le Souef Drive, North Lake Road, and Townsing Road
  • Re-including within the ACP area the properties north of Kidson Street and Dalston Crescent, and the properties north of Hutchings Way included in the original ACP.
  • Increasing the permitted heights within the “Core Precinct” from the maximum 6 storeys recommended by the City to a maximum of 7 stories for non-residential development, 9 stories for residential development and 12 stories at two ‘landmark’ sites.

Scheme Amendment

The proposed ACP contains some elements that are different from Local Planning Scheme 6 as it currently applies to the affected area. To implement the proposals contained within the ACP the Scheme will need to be amended. While this is a separate process and the final contents of any scheme amendment may need to be adjusted to reflect any further modifications to the ACP, yet to be confirmed, the SPC requested that the scheme amendment process be initiated to enable advertising concurrently with the ACP.

The Scheme Amendment primarily proposes changes in residential density and zoning to reflect ACP proposals where they differ from the existing scheme. It also includes textual changes to the scheme where necessary to also enable implementation of the ACP proposals.

A vibrant and exciting focal point of entertainment, hospitality and retail services to create a contemporary, localised centre to accommodate all user’s needs in the one location, supported by a higher density residential precinct.

This is our vision for Kardinya District Centre to be one of the City of Melville's six ‘District Centres’ that are a prime focus for population growth and redevelopment. A centre that offers a mixed use space that provides for the needs of the existing and future Kardinya community.

Proposal Background

Project 1- Shopping Centre Redevelopment

On 16 December 2019 the landowner submitted a Proposed Redevelopment of Kardinya Shopping Centre. This proposal has been assessed and amended in accordance with community, council and government officer feedback. On 23 October 2022, final approval was received from the Metro Inner-South Joint Development Assessment Panel (JDAP).

This proposal only included changes to the current Kardinya Shopping Centre landincluding a new main street, a dining and entertainment precinct, health and wellness services, reconfiguration of the existing service station along with 78 apartments in a 9 story residential building.

Project 2 - Activity Centre Proposal

On 1 July 2020 the landowner submitted a proposed Activity Centre Plan for the Kardinya District Centre. This proposal has not been approved to date.

This proposal includes changes to surrounding commercial and residential areas. Including changes to future land uses, built form, building height and residential densities within an approximate radius of 400m from the centre.

This page follows project 2, the Activity Centre Proposal (ACP).

Initial Activity Centre Proposal

The Planning and Development (Local Planning Schemes) Regulations 2015, require any ACP received by the City to be advertised for community review and feedback.

This initial proposed Activity Centre Plan underwent a public comment period from 23 July - 3 September 2020. Comments received along with officer recommendation were considered by Council at its Ordinary Meeting of Council 17 November 2020. Council resolved to support the proposed Plan subject to the following:

  • Councils proposed modifications being made
  • advertising the modifications to the community
  • holding another public comment period where community can provide feedback on the modified proposal.

The City’s modifications to the proposed Activity Centre Plan were advertised over the period 27 November 2020 - 8 January 2021.

Following consideration of community feedback from the second public consultation period, the City forwarded advice to the Western Australian Planning Commission (WAPC), the approval agency for an Activity Centre Plan. This advice specified that the City only supported the proposed Activity Centre Plan subject to the modifications identified by the City being implemented.

Statutory Planning Committee (SPC) Meeting

The Statutory Planning Committee (SPC) of the Western Australian Planning Commission at its meeting on 21 September 2021, under delegation of the WAPC, considered the proposal and resolved to:

  • Require the City of Melville to advertise a modified Kardinya Activity Centre Plan in accordance with Attachment A, in accordance with the Clause 22(2) of Schedule 2 – Deemed Provisions for Local Planning Schemes, Planning and Development (Local Planning Schemes) Regulations 2015 (Deemed Provisions)
  • Request the City of Melville to advertise the modified Kardinya Activity Centre Plan concurrently with a Scheme Amendment required to implement the ACP, in accordance with Clause 18 of the Deemed Provisions or a longer period as may be required to be consistent with the Scheme Amendment process; and
  • Request the City of Melville to subsequently provide a report on the Kardinya Activity Centre Plan modifications to the Western Australian Planning Commission in accordance with clause 22(2) of the Deemed Provisions.
Second modified activity centre proposal and scheme amendment

A further modified Kardinya ACP document and Scheme Amendment document were prepared by the applicant based on the above recommendations, and submitted to the City.  At the Ordinary Meeting of Council on 13 December 2022 Council considered the proposed Scheme Amendment in accordance with the relevant Planning Framework and made a determination. As per the WAPC recommendation, Council resolved to initiate the scheme amendment required to implement the ACP with some amendments, and to advertise both the scheme amendment and ACP concurrently.

Scheme amendments are governed under the Planning and Development Act and Planning Regulations. In accordance with State Planning Framework requirements the proposed scheme amendment was referred to the Environmental Protection Authority (EPA) of its review under the Environmental Protection Act in January 2023. The EPA has determined that no further environmental review of the proposed amendment is required. As a consequence, concurrent advertising of the proposed scheme amendment and the SPC proposed ACP modifications can now proceed.

Who makes the decision?

The final decision of the ACP is made by the Western Australian Planning Commission (WAPC) who can chose to:

  • reject
  • approve
  • conditional approval on the basis of incorporation of recommendations

In making this final decision, WAPC will consider community, council and officer feedback and planning laws:

To assist with this decision the City will provide a report to the WAPC including officer and council recommendations, and feedback received during engagement periods. More specifically, a copy of submissions and the City’s response to each submission and the City's assessment of the proposal and recommendations for the final decision.

The Minister for Planning is the decision maker of the proposed Scheme Amendment.
